This Slip Lease Agreement is between [Marina name], [Marina address] (the "Marina"), and [Tenant name], [Tenant address] (the "Tenant").
- Slip and vessel. The Marina rents slip [Slip number] to the Tenant for one vessel only: [Vessel name], number [Registration number], length overall [Length overall]. The Tenant may not moor a different vessel without the Marina's written consent.
- Term. This lease runs from [Start date] to [End date]. It does not renew on its own. Either party may offer a new lease before the end date.
- Rent. The Tenant will pay [Rent amount and schedule]. Rent is owed whether or not the vessel is in the slip. Late payments may carry a late fee posted in the Marina rules.
- Use of the slip. The slip is for mooring a recreational vessel. The Tenant may not live aboard, run a business from the slip, or sublet it unless the Marina agrees in writing.
- Insurance. The Tenant will keep liability insurance on the vessel of at least [Insurance minimum] for the whole term and give the Marina proof of coverage before moving in.
- Vessel condition. The Tenant will keep the vessel afloat, in good repair and properly secured with lines and fenders in good condition. If the vessel becomes a hazard, the Marina may take reasonable steps to secure it and charge the Tenant the cost.
- No custody. The Marina rents space only. It does not take custody of the vessel or its contents, and it does not provide security for them.
- Rules. The Tenant will follow the posted Marina rules, including rules on fueling, waste, pump-out, noise and guests. The Marina may update the rules with notice.
- Storms and emergencies. The Tenant will follow the Marina's storm plan. If a storm threatens, the Tenant must move or secure the vessel as the plan requires. If the Tenant cannot be reached, the Marina may act to secure the vessel and charge the cost.
- Default. If the Tenant does not pay or breaks a term of this lease, the Marina may give written notice to fix the problem. If it is not fixed, the Marina may end the lease. Any lien, storage charge or removal of the vessel will follow the law of the state where the Marina is located.
- Responsibility for harm. Each party is responsible for harm caused by its own negligence. The limits and wording of liability terms vary by state, so have this clause reviewed locally.
- Ending the lease. When the lease ends, the Tenant will remove the vessel and leave the slip clean. A vessel left behind will be handled under state law.
- Whole agreement and governing law. This lease and the posted Marina rules are the whole agreement. Changes must be in writing and signed by both parties. The law of [State] applies.
